利用規約 Terms of Service

この利用規約（以下「本規約」）は、株式会社ユリカ（以下「当社」）が提供する「Captio式シンプルメモ」（以下「本サービス」）の利用条件を定めるものです。ユーザーは、本規約に同意のうえ本サービスを利用します。
1. 本サービスについて
本サービスは、メモを作成し、設定した宛先メールアドレスへ送信できるiOSアプリです。オフライン環境でもメモ作成ができ、通信が回復した場合に送信を再試行する機能（未送信管理／再送）を含みます。
2. 機能（プランによる差分）
本サービスの基本機能（メモ作成、送信、履歴、未送信管理／再送、オフライン作成→オンライン再送、言語設定、宛先メール設定＆検証、件名／署名、送信サウンド）は、無料プラン（Free）と有料プラン（Premium）で差分なく提供されます。
両プランの違いは、主に送信回数制限に関するものです（第3条）。
3. 無料トライアル・送信回数制限・Premium
- Day1〜Day7：無料トライアル期間（送信無制限）
- Day8以降：Freeは原則 1日3通まで
- Premium：Day8以降の「1日3通」制限が無効化され、送信が実質無制限
※ただし、第4条の安全対策上の制限が適用される場合があります。
4. 安全対策としての送信制限（全プラン共通）
本サービスの安定運用および送信基盤の保護、不正利用防止のため、Free/Premiumを問わず、以下の制限が適用される場合があります。
- 短時間の連続送信のクールダウン（例：1.5秒）
- サーバ側レート制限（例：端末あたりの1日上限等）
これらは、システム保護・不正対策のためのものであり、個別の条件は予告なく変更されることがあります。
5. 決済・自動更新（サブスクリプション）
有料プランの購入はApp Storeのアプリ内課金により行われ、支払いおよび自動更新はAppleの規約に従います。
ユーザーは、購入後にiOSの設定から自動更新を管理・解約できます。
6. 禁止事項
ユーザーは、以下の行為を行ってはなりません。
- 法令または公序良俗に反する行為
- 迷惑メール、スパム送信、第三者へのなりすまし等、メール送信機能の不正利用
- サービスの妨害、過度な負荷をかける行為（大量送信等）
- 当社または第三者の権利を侵害する行為
- その他、当社が不適切と判断する行為
7. 送信の成否・免責
当社は、メール送信の到達や即時性を保証しません。通信環境、宛先サーバの受信制限、迷惑メール判定、Apple/OSの制限等により、送信遅延・失敗が発生する場合があります。
8. 知的財産権
本サービスに関する著作権、商標権その他一切の知的財産権は当社または正当な権利者に帰属します。
9. サービス変更・停止
当社は、ユーザーへの事前通知なく、本サービスの内容変更、追加、停止または終了を行うことがあります。
10. 規約の変更
当社は、必要に応じて本規約を変更できます。変更後の規約は、本サービスまたは当社ウェブサイト等に掲示した時点から効力を生じます。
11. 準拠法・管轄
本規約は日本法に準拠します。本サービスに関連して紛争が生じた場合、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Service ("Terms") govern your use of "Simple Memo - Captio-style" (the "Service") provided by Yurika Inc. ("we," "us," or "our"). By using the Service, you agree to these Terms.
1. The Service
The Service is an iOS app that lets you write memos and email them to a recipient address you set. It also supports offline memo creation and "outbox" resend behavior when connectivity returns.
2. Features (No functional differences)
Core features are the same on Free and Premium, including: creating memos, sending, history, pending/outbox management and resend, offline creation → online resend, language settings, recipient email setup & verification, subject/signature settings, and send sound.
The main difference between plans is the daily sending limit (Section 3).
3. Free Trial, Limits, and Premium
- Days 1–7: free trial period (unlimited sending)
- From Day 8: Free is generally limited to 3 sends/day
- Premium: disables the Free "3 sends/day" limit after Day 8, making sending effectively unlimited
Note: safety limits in Section 4 may still apply.
4. Safety & Infrastructure Limits (Applies to all plans)
To protect system stability and prevent abuse, we may apply limits to both Free and Premium, such as:
- Short cooldown between consecutive sends (e.g., 1.5 seconds)
- Server-side rate limits (e.g., per-device daily caps)
These limits may change without notice as needed for security and infrastructure protection.
5. Payments & Auto-Renewal (Subscriptions)
Subscriptions are processed through Apple's In-App Purchase system and governed by Apple's terms. You can manage or cancel auto-renewal in your iOS account settings.
6. Prohibited Use
You must not violate laws, send spam, impersonate others, overload the Service, infringe rights, or engage in any conduct we deem inappropriate.
7. No Guarantee of Delivery
We do not guarantee email delivery or timeliness. Delays or failures may occur due to network conditions, recipient mail servers, spam filters, OS restrictions, or other factors.
8. Intellectual Property
All rights in the Service belong to us or rightful licensors.
9. Changes / Suspension
We may modify, suspend, or discontinue the Service at any time.
10. Changes to Terms
We may update these Terms. Updated Terms become effective when posted.
11. Governing Law / Jurisdiction
These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance.
